VW Jetta Comfortlin - need advice

    Hi all,

    I need your advice.

I purchased this new Jetta on 31 March, 2015. Before buying the car, I was promised to get a tank full of petrol. However, on the day of delivery the fuel gauge was showing half empty tank. I pointed that out to the distribution manager at the dealership, who said that they didn't have the fuel card on them. I was asked to get it filled when I come to get the undelivered boot tray.

The car was in the garage until the Easter weekend. During the weekend, we drove to Canberra from Sydney and places around Canberra. We noticed that the needle had not moved at all. Additionally, the cruise control wouldn't function appropriately. Most of the time, we had to turn the engine off and start again to get it to work. On 6th April, I emailed dealer informing this issue. The dealer asked me to contact the service centre.

As this is my first car ever, I wasn't sure of the magnitude of the issue yet, hence was a bit casual. I called the service centre to book an appointment. In our first call, they asked me to schedule an appointment, which I did. Unfortunately, couldn't make it. During the second call, they asked me to contact the roadside assistance. I found it odd, but still called them. As suspected, they said it is not roadside assistance issue, I need to go to the service centre. On 22 April, I went to the service centre without the appointment. They checked the car and said that I need to replace the dashboard to get this fixed. They were unsure if it will take care of the cruise control issue.

I called VW customer support on the same day, who said they will not replace the vehicle even if it is dealer who didn't perform proper checks before delivering the vehicle.

The dealer has the car since 28 April. I got a call now saying they didn't have to replace the dashboard, but just change the small component to get it fixed. I am not happy with the way it is shaping and not sure how serious this issue can get in the future.

Will I have similar or more issues in future? It's the top most question keeps on coming into my mind.

Now, I have two questions for you.

    1. How big is this issue?
    2. Can I deny the repaired vehicle and demand a replacement? What are my chances to get a replacement?
    3. Does this fix make any changes in the valuation of the vehicle? Would it de-value the vehicle?

Hoping to get some advice on this.

Thanks much to all who read it and anybody who attempt to reply.

    Kind regards,
    Vishesh

    1. Probably not a big one

    2. No. your chances of getting a new vehicle are about as high as my chances of marrying a supermodel.
We don't have lemon laws in Australia & if we did you haven't given them sufficient chance to repair the vehicle. I'd suggest you read the fine print in the warranty & acquaint yourself with what your rights are at the ACCC website and the NSW Dept of Fair Trading.

    3. I doubt it. Once it's fixed who will know?

By all accounts, the dealer isn't understanding what you are trying to tell them, hence there is some confusion (eg: them advising you to ring roadside assist.

I'm guessing you are NESB? If so, do the "please repeat back to me what we have agreed on so we both understand properly."

It's easy to get upset when one of the biggest purchases of your life isn't as good as you'd hoped. Stay calm when discussing the situation and try not to talk too fast or too loud as it just sounds like you (anyone, not just you) are getting unreasonable.

edit: Also, you don't have to go back to the selling dealer for warranty. Any VW dealer can do it. It sounds odd that they didn't have a fuel card available - in fact it sounds like BS.
