LOL! really! I always thought that was the case? So in theory the car could be delayed beyond the quoted pickup date by 2 months, and they can still keep my deposit? Seems quite ridiculous to be honest...
Sorry for being so negative, Im just over the whole waiting game. And I know for the fact the car has been in Melbourne for over 3 weeks now.
I have contacted the dealer numerous times for an update and I have nothing. I need to organise the last stage of my finance and insurance for the car still, but I cant at the moment since im getting nothing from the dealer.
Your dealer is slack for not even touching base with you, but yeah, it's not within the dealers control when the car will be delivered. Shipping companies, customs, compliance, delivery companies, even THE WEATHER can delay the delivery of your car. Obviously a dealer cannot be held responsible for the weather. So most contracts do not give you an out, just because they've missed the "estimated delivery date". If it blew out by 2 months, and you wanted/needed to get out, I'm sure there would be avenues you can take - but not if it just misses the estimation by a week or so.
Btw - if you _really_ wanted an R, you should just talk to your dealer. Several people who have had GTI's on order have changed to an R whilst the GTI was already on the way. Depending on the GTI you've ordered and the dealer (and I guess your relationship with the dealer), many would be happy to be taking more money from you!
Having said that, if you are already over the waiting game, I'm not sure what good changing to an R and having to wait until end of November (at the earliest) will do!
I dont want a R that bad. It was just if I dont get anything from the dealer in terms of communication by Mid July. I will look at cancelling. By the time the R arrives I will have more money saved and can actually justify the purcahse.
GTI is fine and a great car. As I said I am so sick of waiting and hearing nothing from the dealer.
They were in constant communication with me before and during the purchase process. After I paid the deposit. I have only been called up once with the VIN number to track it. Everything else has gone on deaf ears.
What I find even more infuriating is the fact that I am on the phones and email for my work (as most people are), and I always get back to people the day they call me or email me. Even if I cant talk to them right away, I will always call back and let them know I will be contacting them on X date and actually make time to do it. Its not bloody hard.
Which dealer is it?
I know personally, on my contract if they don't deliver within 45 days of the delivery date stipulated on the contract, i'm entitled to a full refund no questions asked.
Standard terms and conditions on a Contract to Purchase a Motor Vehicle
4.1 The Dealer will deliver the Vehcile to the Purchaser on or before the Delivery Date stated in this Contract.
4.2 In the case of a new vehicle, if a Delivery Date is not stated on this Contract, the Dealer will deliver the vehicle within three (3) months of this Contract becoming binding on the parties.
7.1 The Purchaser may terminate this Contract if the Dealer has breached any of the obligations imposed on the Dealer by this Contract.
7.2 If this contract is validly terminated by the Purchaser, the Dealer must immediately refund any deposit paid and return any Trade-In Vehicle to the Purchaser. If, in the event the Trade-in Vehicle has been sold, the cash equivalent of the Trade-In Vehicle value determined at the commencement of the Contract shall be refunded to the Purchaser.
Though I would get advice before considering validly terminating the contract.
Yeah - I would imagine if there is any out clause on sharkablue's contract, it'd be something like this rather than the "3 months delivery" that Maltopia has mentioned are from the standard motor vehicle contract conditions.... obviously almost no European manufacturer would be able to deliver within 3 months if a factory order was required.
Which is fine, except for the fact I know the car has been in Melbourne for over 3 weeks now. It will be interesting to see. Because I have a mate who's Tiguan arrived 1 week ago in Melbourne for the same dealer.
So I will be keen to see who gets the call to collect the car 1st.
